Indiana Title Insurance Information

The title insurance laws in Indiana may be similar to those in many different parts of the country, but there are some important differences in Indiana title insurance laws that should be known. If you live in the state of Indiana then you should especially be aware of these facts about Indiana title information. This is also important for businesses that want to expand to Indiana.

The laws involving Indiana title insurance and Social Security Numbers are different in that there are certain times when they can be used. While a legal SSN is required for Indiana title insurance, a document that has a person’s SSN cannot be recorded for title insurance purposes unless it is required to be done by law.

The Title Insurance Enforcement Fund Fee is another part of Indiana title insurance. This is required so that the title insurance will be legal and be officially recognized by the state. A fee of five dollars is required for a closing transaction so that the Indiana title insurance will be legal. The main reason as to why the TIEFF is required for a title insurance policy is because supplemental funding of the state’s insurance department is needed, and it as to work on operating title insurance policies around the state.

A charge that is made at the closing of a property for Indiana title insurance will be needed so that the owner can be protected from any missing heirs, or people who come forward to claim a house after the previous owner died and did not leave a will. Since the state of Indiana works with the American Land Title Association, this can be offered in Indiana title insurance policies.

A group that offers Indiana title insurance will require the right local certification. The Indiana Land Title Association is the group that works to certify title insurance businesses in the state. The ILTA works to assure that its members are following the appropriate measures of offering Indiana title insurance to others. Information on the ILTA can be found online at indianalandtitle.org.

Groups that are based outside of Indiana but are looking to set up business in the state will need the right Indiana title insurance in order to get a secure closing on a new property. A company from outside Indiana will need to give a certificate from its original state of origin so that it will be able to receive the Indiana title insurance that is needed. This is a law that was established by the Indiana Department of Insurance (www.in.gov/idoi).
